WHY THIS MATTERS

The Control of Asbestos Regulations 2012 places what’s known as a “Duty to Manage” on anyone responsible for the maintenance of non-domestic premises. This includes landlords, employers, facilities managers, and property owners. It applies regardless of whether you intend to remove any asbestos, because the duty is about knowing what’s there and managing the risk, not necessarily eliminating it immediately. Getting this wrong, or not doing it at all, carries real legal and financial exposure if an incident occurs or an HSE inspection finds gaps in your records. What is the Duty to Manage asbestos?

It’s a legal obligation under the Control of Asbestos Regulations 2012 requiring anyone responsible for maintaining non-domestic premises — landlords, employers, facilities managers — to identify asbestos-containing materials in the building and manage the risk they present, even if no removal is planned.

Yes, potentially. The duty exists regardless of whether any problem has occurred — it’s about proactively knowing what’s in the building and managing it, not waiting until something goes wrong.

 

A survey identifies and locates asbestos-containing materials in the building. A risk assessment goes further, evaluating the condition of each material, how likely it is to be disturbed, and what level of risk it poses — which then feeds into the management plan.

There’s no single fixed interval — it depends on the building’s use, the condition of materials found, and any changes to how the space is used. We’ll recommend a review schedule appropriate to your property as part of the assessment.

It doesn’t necessarily mean removal is required. If the material is in good condition and unlikely to be disturbed, it’s often recorded and managed in place. Where it does need addressing — because it’s damaged or in the way of planned work — we’ll advise on removal or encapsulation and provide a quote.

Beyond the health risk to anyone using the building, duty holders can face enforcement action, fines, and legal liability if an HSE inspection finds inadequate records or an incident occurs. Proper documentation is also often required for insurance, sale, or lease purposes.
